Curry opposes separate Shirley, Leonard trials

INDIANAPOLIS (WISH) - Marion County Prosecutor Terry Curry says he opposes the idea of a separate trial for the suspects in the south side explosion.

Thursday, Monserrate Shirley's attorney, Jim Voyles, filed a motion for a change of venue for Shirley's trial .Voyles argues that Shirley will not get a fair trial in in Marion County or any of the surrounding counties due to the hostility towards her.

Friday, 24-Hour News 8 asked Marion County Prosecutor Terry Curry his opinion on the motion. Curry says his office is currently working on their response. Curry did say, however, that his office is opposed to a separate trial for the defendants.

Shirley was charged with 49 felonies after the explosion that killed her two neighbors and destroyed dozens of homes in the Richmond Hill neighborhood. Investigators said Shirley, her boyfriend and her boyfriend's brother intentionally set a gas explosion in their home for insurance money.

When asked if the Marion County Prosecutor's office will pursue the death penalty, Curry stated no decision has been made on that matter. Curry and his team will have a series of meetings over the next few weeks to make the decision. A final decision is expected by Feb. 1.
