INDIANAPOLIS (WISH) - Thomas Hardy appeared in court Monday morning and was informed that the prosecutor plans to pursue the death penalty against him in this case. Hardy waived the formal reading of the death penalty charge.

The defense has requested Monica Foster be appointed to handle the death penalty defense, this would be in addition to attorneys David Sherecliff and Ray Casinova

The defense also requested that Hardy be removed from the Marion County Jail and transported to the Indiana Department of Correction and be brought back and forth for future hearings

A pre-trial conference has been set for 1 p.m. on March 15th 1 pm in Criminal Court 6 where attorneys will present proposed scheduling.
