INDIANAPOLIS (WISH/AP) - Indianapolis businessman Tim Durham is still fighting his convictions for fraud and conspiracy.
In June, he and two associates were convicted for handling of money from their Fair Finance Company in Ohio.
Now, Durham’s attorney has a new court filing that states the government has dramatically overstated the loss that can be blamed on Durham and his colleagues.
Attorney John Tompkins says the demand for restitution of more than $208 million is “so large as "to be “impracticable.”
Tompkins says going forward with the government’s claims will only complicate the sentencing process.
Sentencing is still weeks away.
The defense is also protesting a recommended 225-year prison sentence. The federal pre-sentencing report for Tim Durham isn't public, but his attorney has filed a response calling the proposed sentence "absurd."
