Former Marsh CEO stakes stand in court

INDIANAPOLIS (WISH) - Retired grocery executive Don Marsh took the stand Tuesday in federal court. 

The long time CEO of Marsh Supermarkets is accused of defrauding the supermarket and its share holders out of millions of dollars. 

The former executive defended his behaviors but did admit he did not keep through records of his expenses, saying they "did not apply to me” and it “was a common practice”.   

Attorneys challenged Marsh on several of his expenses. They say Marsh spent $4,000 dollars at DNR diamonds in Arizona, several shopping sprees, dinners, and numerous trips on the company jet  to exotic locations. His trips included the Dominican Republic, Naples, Fla., and Utah. 

Marsh was asked to explain these trips, but told the court he "could not remember."

Marsh did admit to using the company jet to visit a mistress in Tennessee. 

The civil trial is expected to last two weeks.
