LOGANSPORT, Ind. (Pharos-Tribune) - A man whose rape conviction was overturned this year is in jail again, accused of videotaping a woman and her daughter in a bathroom, 24-Hour News 8’s news partner, the Pharos-Tribune , reports.
Jason Christopher Burkett, 32, of Logansport, is facing two Class D felony charges of voyeurism.
In April, a special judge overturned Burkett’s 2003 rape conviction. He was originally sentenced to 40 years but appealed, citing issues with his defense attorney. The conviction was for the rape of his then-girlfriend; jurors had to watch a videotape of the incident.
Cass County Prosecutor Kevin Enyeart appealed the special judge’s decision to the Indiana Court of Appeals.
