Marion Co. Prosecutor speaks out on Bei Bei Shuai ruling

INDIANAPOLIS (WISH) - Marion County Prosecutor Terry Curry spoke out on a recent development in the Bei Bei Shuai case Friday.

Prosecutors say Bei Bei Shuai killed her child by eating rat poison in 2010.

Recently, a judge ruled that a medical examiner's conclusion that the baby's death was caused by the rat poison Shuai ate while pregnant is unreliable and cannot be used against her. Shuai's lawyer previously argued that the pathologist who performed the autopsy never considered other things that could have caused the newborn's death.

Friday, Marion County Prosecutor Terry Curry said he respects the judge's ruling and says the prosecution is now looking for other options.

Curry says his team is still in the process of reviewing the order as well as working with the Attorney General's office. It has not yet been decided if they will initiate an appeal.

Moving forward, Curry says they currently have three options -- one being to initiate an appeal. Another option would be to have a different pathologist review the case materials and enter a different opinion on the matter. The third option would be to accept the court's ruling and continue forward on the charge. 

Shuai was released on bond last May. Her trial is set for April 22.
