MUNCIE, Ind. (WISH) - Adam Maxwell is accused of betraying the trust of parents. He worked as a volunteer for The Spirit of South Marching Band Booster Club. The group helps train band members for Muncie Southside High School.
Police accuse the 21-year-old of using his position to have sex with a 16-year-old Muncie student.
“Having a sexual relationship is a powerful thing for people and he couldn’t overcome the feelings he had for the girl,” said Sgt. Linda Cook with Muncie Police.
Investigators believe Maxwell and the girl started the relationship during the summer.
Their cover-up came to an abrupt end when the victim's father found a nude photo of Maxwell on his daughter’s phone. The father called police. Investigators questioned Maxwell who admitted to having a sexual relationship with the girl.
“That parent done what he should - he checked the phone logs and found something out he probably wouldn’t have found out," said parent Vicki Stanley.
Indiana state law lists the age for sexual consent is 16 years old, but because Maxwell held a position of authority over the victim it is considered a crime.
Spokesperson for Muncie Community Schools tells 24-Hour News 8 that Maxwell is no longer serving as a volunteer for the booster group, and that he was never an employee of the district.
Maxwell is currently facing a child seduction charge and if convicted he could serve an 18 month prison term. Maxwell was released from Delaware County Jail after positing $5,000 bond.
