Pizzeria owner won't be charged in fatal shooting

RICHMOND, Ind. (AP) - An eastern Indiana prosecutor says a pizzeria owner won't face charges in the fatal shooting of a man who tried to rob his restaurant.

Wayne County Prosecutor Mike Shipman tells the Palladium-Item Terry Padgett broke no laws when he shot 30-year-old Freddie McCoy last month inside Mercurio's Pizza in Richmond.

Shipman says a video recording shows McCoy entering the eatery wearing a ski mask and gloves, running to the front counter and grabbing the cash register. It then shows Padgett's daughter yelling for her father as she tries to prevent McCoy from stealing the cash register.

Shipman says Padgett ran to counter and shot McCoy after repeatedly telling him to stop. He says Padgett wasn't sure if McCoy had grabbed just the cash register or his daughter as well.
