Supreme Court to hear man's appeal in mother's murder

INDIANAPOLIS (AP) - The Indiana Supreme Court is taking up the appeal of a central Indiana man found guilty but mentally ill in his mother's fatal 2002 stabbing.

The court was scheduled to hear oral arguments Thursday in the case of Brad Passwater, who was convicted of killing 48-year-old Sandra Passwater at the home they shared in Lapel. WIBC-FM reports police say Brad Passwater hit his mother in the head twice with a frying pan and stabbed her in the temple with a knife.

Passwater told a psychiatrist during his 2004 trial he wanted to kill his mother to prevent the end of the world. He's serving a 60-year prison sentence.

Passwater claims his trial lawyer led him to believe he would be sent to a secure hospital rather than prison.
