ACLU sues BMV over license suspension

INDIANAPOILS (AP) - A woman is suing the Indiana Bureau of Motor Vehicles for suspending her driver's license over not having auto insurance even though she didn't have a car to drive at the time.

The American Civil Liberties Union of Indiana filed the lawsuit Wednesday in Marion County.

The suit claims BMV made a list of previously uninsured motorists and began checking to see if they later obtained insurance. The agency suspended Lourrinne White's license when she didn't respond. White says she didn't get the notice. The suit says White had just bought a car but didn't insure or drive it because it didn't run.

The suit says White wasn't otherwise required to carry insurance and that the BMV didn't publicize the rule.

A BMV spokesman declined to comment on the suit.
