Counselor says council members violated Ind. law

ELKHART, Ind. (AP) — Indiana's public access counselor says city council members in Elkhart violated state law last fall by holding an impromptu news conference.
Wednesday's ruling by public access counselor Joseph Hoage says September's news conference organized by five city council members was not a "blatant" violation, but did constitute a meeting that was not properly advertised in advance.
The Elkhart Truth reports that the meeting's purpose was to urge Elkhart Mayor Dick Moore to consider cost-saving measures before council members began reviewing the city's proposed 2013 budget.
Hoage found that because seven of the council's nine members ended up discussing city issues at the news conference it met Indiana's basic definition of a public meeting because more than a quorum of the council was present.
