Court: Escapee can't appeal conviction

HAMMOND, Ind. (AP) - The Indiana Court of Appeals has ruled a woman arrested in Tennessee 35 years after she escaped from prison cannot appeal her conviction.
The Times of Munster reports ( http://bit.ly/IYs5kk ) the court ruled Thursday that 68-year-old Linda Darby is not entitled to an appeal because she missed the original deadline to file for one and her escape prevented her attorney from filing a belated appeal.
Darby was convicted in the 1970 shooting death of her husband, Charles, in Hammond and sentenced to life in prison. In March 1972, she escaped from the Indiana Women's Prison in Indianapolis by climbing over a barbed-wire fence.
She was arrested 2007 in Pulaski, Tenn., where she had been living under the name Linda Joe McElroy.
