FORT WAYNE (WISH) - A company that owns terminals used for online gambling says the Indiana Gaming Commission violated its
constitutional rights when agents seized 51 of the machines and $3,000 cash from two businesses in Fort Wayne last month.
In a lawsuit filed this week in federal court in Fort Wayne, Florida-based Buckwheat Holdings asks a judge to block such future enforcement by the state.
The Journal Gazette reports the Indiana Alcohol and Tobacco Commission said in December that the so-called "sweepstakes machines" popping up in businesses that sell alcohol are illegal, even for businesses authorized to have pull-tab type games.
The lawsuit argues the machines are essentially constitutionally protected video games and a means of enticing purchase of Internet access.
State officials declined to comment on the lawsuit.
