Video from Sugarland deposition released; band spokesman balks

INDIANAPOLIS (WISH) - At least part of the Sugarland deposition given in conjunction with lawsuits filed over the deadly Indiana State Fair stage rigging collapse was released Monday.

An attorney representing victims from the Chicago area plans to release the video deposition of Sugarland frontwoman Jennifer Nettles.

Nettles and Kristian Bush stopped in West Virginia last week to be deposed on a limited basis about the Aug. 13 collapse.

Sugarland spokesman Allan Mayer took issue with the video release, calling it "selectively edited." The portion of video released Monday was the portion of the deposition during which attorney Ken Allen, whose firm represents six of the victims of the stage rigging collapse of Aug. 13, questioned Nettles.

"In our opinion, the deposition tells a different story than the one being portrayed by Nettles' attorneys," Don Asher, general manager for Ken Allen Law in Valparaiso, told CNN Entertainment. "[Sugarland] could have delayed the start of the concert or sought to cancel it. They had access to Doppler radar and were aware of the storm approaching. In our opinion, they bear ultimate responsibility."

Mayer took issue with that characterization, however: "Their self-serving assertions about what Sugarland knew or could have done are contradicted not only by Kristian (Bush's) and Jennifer's complete testimony but also by the independent reports of the Indiana Occupational Safety and Health Administration and the investigators hired by the state."

The northern Indiana law firm told CNN it is considering releasing video of Allen's questioning of Kristian Bush soon, possibly Tuesday.
