Pre-trial diversion agreement settles assault case

DANVILLE, Ind. (WISH) - One of the ex-Carmel High School basketball players accused of assaulting a teammate while on a school bus won’t go to trial on an assault charge.

Robert Kitzinger entered into a pre-trial diversion agreement with the court. Under terms of the agreement, Kitzinger must write an apology to the victim, pay the court costs and continue as a student in good standing. He has already completed required counseling. Kitzinger admitted to being a part of the battery as part of the agreement.

If Kitzinger completes all of the tasks under the agreement and doesn't get in any other trouble in a year, the charge will be dropped from his record.

Kitzinger pleaded guilty to a similar charge in Hamilton County.
