INDIANAPOLIS (WISH) - The defense for embattled IMPD Officer David Bisard this week filed an official motion asking the judge to reconsider allowing additional blood evidence to be tested.
John Kautzman, attorney for Bisard, filed a motion Tuesday asking Judge Grant Hawkins to reconsider his ruling that required testing on a second vial of Bisard's blood taken the day he crashed his IMPD patrol car into a group of motorcyclists, killing one.
Just days after the judge's ruling, it was revealed that the blood evidence in question had been removed from cold storage . The Marion County prosecutor's office discovered the issue while moving forward with the order to test the blood.
That order came after months of wrangling over previous blood tests that showed Bisard had alcohol in his system at the time of the crash. Hawkins in May 2011 ruled that test to be inadmissable as evidence because the person who drew the blood was not among allowed to do in such a situation so under state law.
