UPDATE: A judge has ruled that David Bisard will stay in jail …

INDIANAPOLIS (AP) - Prosecutors are preparing to send blood and DNA samples taken from an Indianapolis police officer involved in a fatal crash to a Texas laboratory for testing to determine if he was driving drunk.
Marion County Deputy Prosecutor Denise Robinson said Tuesday prosecutors anticipate sending the samples out next week. Testing is expected to take two to four weeks.
A judge's order allowing the tests went into effect Monday. Officer David Bisard's attorney had fought the testing because the samples were mishandled by investigators.
Prosecutors say the blood initially will be examined to determine if it's suitable for testing.
Bisard is charged with reckless homicide and other charges in a 2010 crash that killed 30-year-old Eric Wells and injured two other people.
Bisard's attorney had no comment.
