Couple injured in Bisard crash says they had no choice but to file lawsuit

INDIANAPOLIS (WISH) - The couple who have begun to rebuild their lives after being critically injured in the crash involving an IMPD officer have filed a lawsuit against the city and the police department.

The lawsuit was filed just a few weeks after Mary Mills and Kurt Weekly got married, four years to the day after they first met, and just more than a year after their lives changed forever because of the crash .

Mills and Weekly married Sept. 17 in Myrtle Beach, S.C.

"I've never been married before so, it's incredible. And Mary's the one that's done everyting, and it makes me happy," Weekly said.

"Did I tell you lately that I love him?" Mills said.

Both worked together as employees at DFAS. In the year since the Aug. 6 accident that killed Eric Wells, they've both had repeated surgeries and had to learn to walk again.

"A year ago was not so great,” Weekly said. “Now it is better. It’s not 100 percent, but it is the best I’ve got."

A brain injury left Kurt with no memories. He speaks more slowly now. He smiles at the thought of choosing Mary as his love a second time around.

"When I was hurt, unfortunately, I got hit in the head, and I didn't know anything. What I needed to know she taught me,” Weekly said. “Everything she has done for me since then has been wonderful."

Mills said the physical rehab hasn’t been the only difficult part of the past year.

"We can't move forward with our lives and what we want to do until we take care of the things that are held over us,” she said. “We go to court, and for nothing. Three months later, go, and then three months later."

Insurance no longer covers rehab for either Mills or Weekly. With bills totaling more than $500,000, the couple was forced to file the lawsuit against the city and Indianapolis Metropolitan Police Department, said their attorney Mark Ladendorf.

"Almost a year has passed, and no offer has been made. Nothing given to them. In fact, [the city and IMPD] say we aren't going to pay now, and we are going to make you go through a lawsuit," Ladendorf said.
