INDIANAPOLIS (WISH) - The former funeral director found guilty on a forgery charge during a trial that ended when a jury could not reach a verdict on 13 other counts will be retried on those counts.

Marvin Boatright was sentenced to two years of home detention and two years of probation Friday on the forgery charge.

The State will attempt to re-prosecute Boatright on the remaining 13 charges on Nov. 13.

Prosecutors say they will not, however, prosecute Boatright in connection with a 2009 case where an embalmed baby was found in a dumpster near where he worked. He was never charged with the discovery of the baby’s body but police once mentioned him as a person of interest.

Boatright testified Friday saying he never indended to committ forgery.

Boatright lost his license in 2008 after being accused of cremating a body against a family’s wishes. He was also accused of forging death certificates and lying about having a valid license number.
