INDIANAPOLIS (WISH) - Jurors have reached a verdict Friday night after hours of deliberating the fate of former supermarket CEO Don Marsh.
The jury has awarded Marsh Supermarkets $2.2 million. Don Marsh must now pay the company that sum.
Attorneys say the decision is not final. The judge still has to approve the decision.
The issue at hand was Marsh’s behavior and spending while leading the company. The grocery chain was suing Marsh saying while CEO he defrauded the chain and its shareholders out of millions.
The company says while CEO, Don Marsh used its money as his personal checkbook to pay for trips to places like the Dominican Republic and Russia, on shopping sprees at Tiffany's, and for visits with mistresses.
They were asking for millions of dollars back.
But attorneys for Don Marsh say he did not defraud the company. They claim this is an attempt to smear his reputation.
They say his travels and expenses were needed to promote the company.
Don Marsh was counter-suing – asking for close to $2 million he says he's owed in severance pay.
