INDIANAPOLIS (WISH) - A tentative plea deal has been struck that would waive the teen accused of shooting a convenience store clerk in the head into adult court, officials confirmed Wednesday night.
A hearing on the matter of whether the 15-year-old should be waived to adult court had been under way, and the judge was set to rule Friday. The plea deal involves adult charges.
If the juvenile court judge accepts the stipulations set forth by the state and defense, the 15-year-old will be waived to adult court, where a new judge must approve the plea deal before it becomes final.
The teen is accused of shooting Marcella “Marcy” Birnell in the head during a robbery attempt just after midnight Oct. 20. Just more than a week later, prosecutors asked that the teen be waived to adult court .
Birnell is still facing a long road to recovery , and her family has been actively pushing lawmakers and business owners to improve safety measures to protect workers at 24-hour stores.
