Two brothers hit by pickup, one killed

INDIANAPOLIS (WISH) - Family members have confirmed a tragic death. Nicholas Malott, 22, was killed Friday after he and his brother were hit by a pickup truck.

Malott and his brother Dusty Seiler, 24, were pushing their car after it ran out of gas near West Washington Street and Bridgeport Road shortly before 6 a.m. Friday. The two were wearing reflective vests and had their flashers on when a pickup truck plowed into the two.

“I heard a loud motor behind me,” said Seiler. “By the time I turned it was too late.”

Seiler was forced into action shortly after the crash – dragging his brother to the side of the road.

The driver of the truck is believed to be 52-year-old Timothy Childers of Indianapolis. He was not arrested.

Childers refused a blood draw and gave police no clear indication on how the crash happened. Officers are interviewing Childers and witnesses, but so far they say it is unclear if drugs or alcohol contributed to this accident.

Malott was described as a young father who loved life and was excited about having a job.

“It’s a shame,” said Kimberly Deppe.

Childers told police at the time of the crash he was taking Cymbalta the antidepressant. Because the 52-year-old refused a blood draw he automatically forfeits his license for a year.

Seiler said right after the crash Childers did not ask if the brothers needed help. Instead he says they were berated for being in the road. Seiler says he is not surprised by Childers actions.

Childers could face criminal charges once the crash investigation is complete.
