FRANKFORT, Ind. (AP) — The Indiana Court of Appeals has ruled against a former state lawmaker seeking to recover legal fees and damages from a central Indiana county.
Clinton County's commissioners fired then-state Rep. Jacque Clements from her job as Clinton County's deputy auditor in 2009 and sued her over problems with the county's tax assessment software.
A county trial judge ruled against the commissioners, saying Clements had professional immunity for decisions she made in her county job.
The Kokomo Tribune reports Clements counter-sued the commissioners for malicious prosecution, seeking legal fees and damages. Tuesday's ruling upheld a trial court decision throwing out her counterclaims against the commissioners. Clements can appeal to the Indiana Supreme Court.
She was defeated in the 2010 primary by current Republican state Rep. Heath VanNatter of Kokomo.
