Death penalty case moves ahead

ROCHESTER, Ind. (AP) - A judge has ruled that jurors will be sequestered if a man goes to trial on charges that fatally shot an 81-year-old woman during a break-in at her northern Indiana home.

Fulton County prosecutors are seeking the death penalty against 24-year-old Roy Bell of Delong for the November attack on Wilma Upsall at the home about 10 miles northwest of Rochester she shared with her daughter and son-in-law.

The Rochester Sentinel reports ( http://bit.ly/uKlS5q ) the judge approved the request Thursday from defense attorney Edward Ruiz for sequestering the jury. Bell is next scheduled to be in court for a June 28 pretrial hearing.

Prosecutors have also charged 34-year-old Jason Miller of Argos and 25-year-old William Scroggs of Delong with murder in Upsall's slaying, but aren't seeking the death penalty against them.
