ZIONSVILLE, Ind. (WISH) - The U.S. Equal Employment Opportunity Commission has filed a lawsuit accusing a company of not promoting a man at a Zionsville dry cleaning business because he is black and Tuesday night, that company, Tuchman Cleaners is responding.
The EEOC said the incident dates back to May 2010 when an assistant manager position was open and the black man was recommended for it.
Despite training and acting in the new assistant manager position, the man wasn’t officially promoted or given a raise, the complaint says.
A white employee was later given the position and when the worker quit, the black man still wasn’t promoted.
Tuchman Cleaners contacted 24 Hour News 8 Tuesday evening saying has not been given any notice of this lawsuit by the Equal Employment Opportunity Commission regarding an employee claiming racial discrimination. The company wanted to issue the following statement:
"Tuchman Cleaners steadfastly maintains that:
(i) the employee who filed the claim did not have the required training for the position at the time he applied for the position;
(ii) the employees who filled the position all had the required training;
(iii) once this employee completed the required training, he was promoted; and
(iv) Tuchman Cleaners is 100% committed to providing equal opportunities for all our employees. Race has not and will never be a consideration for hiring or promotion at Tuchman Cleaners.
It is because of our commitment and pride that we refused to settle this employee’s claim for an insignificant amount of money and instead will vigorously defend our principals and this lawsuit in court. "
