FRANKLIN, Ind. (WISH) - Should the man accused of knowingly spreading HIV be allowed to withdraw his guilty plea? That’s a decision a Johnson County judge will have to make after hearing arguments Monday.

Tony Perkins wants the plea withdrawn claiming private tests show he doesn’t have HIV. He’s accused of targeting and having sex with women to intentionally spread HIV.

A jury will not hear the case against Perkins, instead, the judge will decide the outcome of the case in a June 28th hearing.

Meanwhile, Perkins has a court date Thursday to face child pornography charges. Investigators say they found sexually explicit pictures on Perkins’ computer while investigating the HIV case.
