KOKOMO, Ind. (WISH) - The construction manager for a failed factory project in Tipton County is suing the company for millions of dollars, 24-Hour News 8 news partner the Kokomo Tribune reports .
Walbridge Aldinger Co. filed the lawsuit Tuesday against Getrag KG, Getrag International and Getrag Transmission LLC involving the planned $580 million joint manufacturing plant with Chrysler at the intersection of 31 and Ind. 28 that was never completed.
Attorneys for Walbridge say in the lawsuit that a substantial portion of the damages sought will be used to pay subcontractors owed for their work.
Getrag KG formed Getrag Transmission LLC in 2007 and claims it is responsible for the payments. But Walbridge attorneys describe the LLC as a shell coporation, and alleged that Getrag KG was providing the funding and pulled a majority of it on Dec. 1, 2007, the day a work stoppage order was issued on the project.
Getrag Transmission subsequently filed for bankruptcy protection, and Getrag KG has maintained it has no responsibility to pay Walbridge.
