Florida man jailed after rape overheard on PlayStation 4, deputies say

PASCO COUNTY, Fla. (WFLA) – A video gamer said he was playing a game through an online multiplayer network when he heard his opponent commit a rape.  A Pasco man was arrested for the crime. 

According to an affidavit, the suspect, identified as 18-year-old Daniel Enrique Fabian, of New Port Richey, had been playing Grand Theft Auto with another person through a PlayStation 4. He told his opponent he had a girl over at his house who he planned to “smash.” 

They stopped playing the game for about 15 minutes. The witness said Fabian left his microphone on and he heard the girl groan and say “no.” After about 15 minutes, the two parties resumed playing, the report states. It’s unclear if the gamer reported the crime.

The victim later told detectives she was sitting on Fabian’s bed when he put his hand over her mouth and pushed her down and raped her.

She then completed a SAVE (Sexual Assault Victim Exam), which supported her allegation of sexual abuse, and a DNA swab taken from her thigh linked Fabian to the crime.

Fabian was arrested for lewd and lascivious battery/sexual activity with a victim between the ages of 12 and 15. 

He’s being held at the Land O’ Lakes Detention Center.
