Newborn blood sample case appealed to Indiana’s high court
INDIANAPOLIS (AP) – An Indiana couple seeking the destruction of millions of newborn blood samples stored in a state warehouse is appealing their case to the Indiana Supreme Court.
The couple’s attorney filed a petition Thursday asking the state high court to take up the case.
A lawsuit filed on behalf of the couple’s 9-year-old daughter seeks the destruction of her blood samples and those of some 2.5 million other people whose blood was collected as newborns for disease screening between 1991 and May 2013.
The Indiana Court of Appeals dismissed the suit last month. A trial court had dismissed it last year. Both found the girl was in no imminent danger of suffering harm by Indiana holding onto her blood and that of others after mandatory disease-testing was completed.
