Sentencing set for man accused of beating 1-year-old to death
INDIANAPOLIS (WISH) – The man found guilty for his role in the death of a one-year-old boy was sentenced Tuesday.
Frank Larkins III was convicted of four felonies, including aggravated battery. On Tuesday, he was sentenced to 34 years for three of the charges. A second count in the case was dismissed. According to the prosecutors officer, a fifth count will be decided in the next 30 days by a briefing between the state and defense.
Police said in October 2015, they found Elijah Polk dead in Larkins’ home.
Polk was the son of Larkins’ girlfriend, Diamond Miller.
Court documents said Larkins, beat 1-year-old Elijah Polk.
Polk was found dead in his home in the Willow Brook Lake apartment complex on the near northeast side of Indianapolis.
According to court documents, when emergency crews arrived on scene, Elijah had been dead for some time.
Doctors who evaluated him said if he’d been taken to the hospital at the time it happened he could have survived. They also say they found evidence Elijah had been injured before. Court documents indicate the child’s biological father had confronted Larkins and Miller in the past about Larkins “putting his hands on my son.”
Miller was sentenced to 20 years in prison in September for failing to get medical help for the boy.
