INDIANAPOLIS (WISH) - A 23-year-old burglary suspect is in critical condition after a 64-year-old homeowner shot him in the chest just before 2:30 Thursday afternoon.

Indianapolis Metropolitan Police say Phillip Dubbs came home to find his front door kicked in; he walked in and found Bryan Tuggle ransacking his home.

Police say the two men got into a scuffle and Dubbs opened fire, striking Tuggle in the chest.

Tuggle was rushed to Wishard Hospital where he is listed in critical condition. Police say he has been arrested and will be charged for burglary.

Police say Dubbs acted within the laws of self defense and charges are not anticipated to be filed against him.
