Indiana congressional candidate files lawsuit against Kentucky State Police officer
LOUISVILLE, Ky. (WISH) – A candidate for congress in Indiana’s 9th District is suing a Kentucky State Police officer.
Russell Brooksbank, a Libertarian candidate for congress, has filed a suit against Dewayne Koch, a sergeant with the Kentucky State Police.
In the suit, filed in Louisville, Brooksbank alleges Koch violated his first, fourth and fourteenth amendment rights. The suit stems from Brooksbank’s September arrest in Louisville.
At the time, Brooksbank was arrested following a traffic stop in which an alleged struggle ensued between Brooksbank and the officer over Brooksbank’s cell phone.
Additionally, Brooksbank,45, also states he was subjected to battery, false arrest/false imprisonment, malicious prosecution, and negligence.
At the time of his arrest Brooksbank said “Today I was a victim of an overzealous police officer who wears his emotions on his sleeve.”
Brooksbank is running against Democrat Shelli Yoder and Republican Trey Hollingsworth in Indiana’s 9th Congressional District.
