“The report is pending finalization the result of any follow-up investigative requests from the Prosecutor’s Office, and the inclusion of the autopsy report which is anticipated to be received within the next several weeks,” ISP said in a news release.

Rightsell was shot and killed by Trooper Daniel Organ on Dec. 28, 2018.

Organ said he pulled up to an abandoned vehicle that he had tagged earlier in the day. When he returned, he found Rightsell at the front of the vehicle with the hood open.

Organ says Rightsell ignored his verbal commands and that Rightsell grabbed a gun that Organ had seen on Rightsell’s waist.

ISP said Organ had no previous discipline record and that he had been a trooper since October 2017.
