Sandusky’s attorney argues for new trial

BELLEFONTE, Pa. (WHTM) – Jerry Sandusky yelled to reporters Monday as he was led into the Centre County Courthouse.

“There’s much to say,”  he said. “For now, Al Lindsay is going to say it. Just listen to him.”

Lindsay is Sandusky’s attorney. He tried to convince Judge John Cleland that the 72-year-old former Penn State assistant football coach deserves a new child sexual abuse trial, citing more than 33 separate issues.

“The prosecuting attorney commented on the failure of Sandusky to take the stand. You cant do that,”  Lindsay said. “There was no trial strategy on part of the defense counsel. They really didn’t have time, to be honest with you. Read some of the stuff that has been filed because it is an eye opener. It truly is.”

Lindsay asked the judge for permission to question witnesses, including Sandusky’s former lawyers, about the investigation and trial. That includes former Carlisle attorney Karl Rominger.

The prosecution argued that the defense did not provide enough evidence to back up their claims.

“Our strongest argument is from the record of trial itself on a lot of these issues, and we do believe that we set forth sufficient information,” Lindsay said.

After the hearing, Sandusky spoke again through a statement read by one of his lawyers.

“Just like the rest of the work, I am imperfect. However, I stand firm in knowing my slate is clean of these alleged heinous crimes,” he said. “I have not been one to turn my back on injustice. This is an opportunity for all to realize and separate from the pharisees who have disguised and masked their motives and actions.”

“This was a profound injustice that occurred here and we would like to get a fair shake,” Lindsay said. “That’s all we ever asked. We want a fair trial. What happened before was not a fair trial.”

Cleland gave no indication when he’ll make a decision. Lindsay said if they are not granted an evidentiary hearing, they will appeal.
